Terms of Service

⚠️ Draft for legal review. Not legal advice. A lawyer must review before paid advertising — especially withdrawal, limitation of liability and venue.

Last updated: 2026-10-08 · Version: 1.2

1. Who you contract with

The service is provided and billed by Hubinx Serviços de Internet Brasil Ltda. (“Hubinx”, “we”). Hubinx Inc., Delaware is the brand’s U.S. company and is a party only to Ventures program agreements. These Terms apply to you as a product creator (“Creator”, “you”), and to partners where indicated. By ticking the acceptance boxes at sign-up and at checkout, you confirm you are 18 or older and accept these Terms, the Privacy Policy and the Confidentiality Policy.

2. Where the service is available

To residents of the countries listed in the site footer (currently the United States and Brazil). Sign-ups and purchases from other countries are not accepted for now.

3. What the Discovery is

A feasibility analysis of your product, based on your answers to the 62-question form. It results in a feasibility verdict, a per-criterion reading and, when applicable, the complexity band and the Technical Briefing proposal. The analysis follows Hubinx’s documented method, with drafting supported by artificial intelligence tools; a Hubinx person reviews every verdict before it reaches you.

4. What the Discovery is NOT

It is not a guarantee of commercial success, a promise of manufacturing or regulatory approval, an engineering opinion, a sealed design or a certified calculation, nor legal, accounting or investment advice. Hubinx is not ISO-certified: the method is structured on ISO 9001 §8.3 design-control principles. The report depends on the information you provide.

5. Price and second idea

The Discovery costs US$ 199, charged in U.S. dollars, upfront, through Stripe; your bank may charge conversion fees. The form opens after payment is confirmed. If the verdict is not viable, you may submit one new idea at no cost within 30 days of delivery, as a courtesy. The Briefing has a fixed price per band (T1 US$ 1,200, T2 US$ 2,400; T3 quoted case by case). Each execution stage is quoted before you fund it.

6. Withdrawal and refunds

Full refund until you submit the questionnaire. For residents of Brazil, also within 7 days of payment while the report has not been delivered (Brazilian Consumer Code, art. 49). At checkout you ask for an immediate start and acknowledge that once the report is delivered the service is complete and withdrawal no longer applies. Requests are made on the Discovery page itself and the amount goes back to the same card. The second idea is a courtesy and does not replace this right.

7. Delivery time

Up to 10 business days after the complete form is submitted. A good-faith estimate; it may vary with complexity.

8. Your responsibilities

You warrant that the information is true, that you hold the rights to the idea or are authorized to submit it, and that you will not submit illegal content, content infringing third-party rights, or content whose purpose is to cause harm.

9. Out-of-scope categories

Hubinx does not analyse medical devices, structural automotive parts, aeronautical products, weapons and their accessories, ammunition and explosives, children’s products and toys, or cosmetics. At checkout, before paying, you declare your product is not on this list. If, despite the declaration, it is, we deliver whatever technical analysis is possible; the right in clause 6 still applies.

10. Intellectual property

Your idea is yours. On the Direct track, the idea, the brand and the deliverables you pay for are yours; Hubinx takes a commission on execution and on marketplace sales. On the Ventures track the window rules apply, including the 7% stake if the product is selected. Submitting grants Hubinx a limited license to use your information only to produce your Discovery and the contracted stages and, internally and without disclosure, to measure the method’s accuracy. The Hubinx methodology and system belong to Hubinx.

11. Limitation of liability

For business customers, Hubinx’s total liability is limited to the amount paid for the service concerned, excluding indirect damages and lost profits. For consumers, all rights under applicable consumer protection law apply in full.

12. Automation and support

Some status replies may be automatic and are labeled as such. Refunds, complaints, disputes and changes of deadline or scope are handled by a person. You may ask at any time for an automated decision to be reviewed by a person.

13. Partners

Freelancers, builders and suppliers are independent businesses: they accept or decline each job, with no exclusivity and no minimum hours. The US$ 20 verification fee pays for the dossier review and is refunded in full if the registration is declined. Access to opportunities is governed by the Network Confidentiality Agreement (NDA).

14. Changes

We may update these Terms and publish the new version with its date. A paid Discovery follows the version in force at payment.

15. Governing law and venue · Contact

Consumers residing in Brazil: Brazilian law and the courts of your domicile. Other customers residing in Brazil: Brazilian law and the courts of Taquara, Rio Grande do Sul. Customers residing outside Brazil: the laws of the State of Delaware (USA) and the courts located in Dover, Delaware. Contact: [email].

Privacy Policy

⚠️ Draft for legal review. Compliance with LGPD (Brazil) and applicable U.S. privacy laws requires professional validation.

1. Who controls your data

Hubinx Serviços de Internet Brasil Ltda., as controller. Hubinx Inc., Delaware acts in Ventures program agreements. Data protection officer (DPO): [email].

2. What we collect

Account (name, e-mail, hashed password, country); consents (what you accepted, when, text version, IP and browser); Discovery (your answers and attachments); payment (processed by Stripe — we do not store your card); technical (access logs, IP); and, if you asked for the sample report, your name and e-mail.

3. Why we use it

To provide the service, process payments, give support, meet legal obligations and prove consents. Marketing e-mail only with your consent, with one-click unsubscribe. Visit and ad measurement only if you accept cookies (clause 8). We do not sell your data or use your idea in advertising.

4. Who we share it with

Processors under contract, only what is needed: Stripe (payments), Supabase and Vercel (database and hosting, in the U.S.), Resend (e-mail delivery), Anthropic (draft analyses, checks and support — under the provider’s commercial terms this data is not used to train models), Google and Meta (only if you accept analytics and advertising cookies). Network executors receive only the technical slice, without your identity, under confidentiality. Authorities, if required by law. For partners, the Brazilian company number (CNPJ) is checked in a public registry (Receita Federal, via BrasilAPI).

5. International transfers

Your data is processed in Brazil and the U.S. For transfers we use the standard contractual clauses approved by Brazil’s ANPD (Resolution 19/2024) or another mechanism LGPD allows.

6. Retention

Discovery data while your account exists or for 5 years after delivery; consents for as long as needed as proof; tax data for legally required periods; mailing list until you unsubscribe. You may request deletion earlier, subject to legal retention.

7. Your rights

Access, correction, portability, deletion, information on sharing and withdrawal of consent — channel: [email]. You may also ask for a person to review decisions made solely by automated processing (LGPD, art. 20).

8. Cookies

Essential (always on): session, language and your cookie choice. Analytics and advertising (Google Analytics, Google Ads, Meta Pixel): they only load after you click “Accept”; rejecting changes nothing in the service. Change your choice any time under “Cookie preferences” in the footer.

9. Security · Minors · Changes

Proportionate technical measures (encryption in transit, role-based access, least privilege). The service is for people aged 18 or older. New versions are published with their date.

Confidentiality Policy

⚠️ Draft for legal review. The non-use clause and the trade-secret clause require validation in both jurisdictions.

Your idea is yours — and protecting it is a condition of our business model. Hubinx only works if creators trust us with their concepts.

1. What counts as Confidential Information

Everything you submit: description, differentiator, drawings, CAD, prototypes, market data, pricing, strategy — whether or not marked “confidential”. Not confidential: information already public, lawfully received from third parties, or independently and demonstrably developed without using your material.

2. What Hubinx commits to

Use your information solely for your project; not disclose it outside your flow; not use your idea to build our own product nor pass it to another creator; limit internal access to what’s needed. Artificial intelligence tools used in the analysis operate under contract, as processors, with no right to use the material for themselves. Hubinx may reuse a delivered report, internally and without disclosure, to measure the accuracy of its own method.

3. Blind-executor model

During execution, three barriers protect you: anonymity (the executor receives only the technical slice — no name, brand or commercial context); compartmentalization (work split into packages; no one receives the whole project); network NDA (every partner signs confidentiality and IP assignment before receiving any task).

4. Intellectual property

Your idea and information remain yours. Project deliverables are yours under each stage’s terms; the Hubinx methodology is Hubinx’s. Confidentiality protects secrecy, it is not a substitute for a patent — if your idea is patentable, formal protection is your decision.

5. Similar ideas

We work with many creators; similar ideas may arrive independently. We never transfer information from one project to another. Independent similarity alone is not a breach — using your material would be.

6. Term · 7. Exceptions · 8. Breach

The duty applies during the project and for 5 years after last contact (or while the trade secret lasts). Disclosure only if required by law, with notice where permitted. Breach entitles us/you to judicial remedies, including injunctive relief.

Ventures window rules

The rules of the current Hubinx Ventures window: choosing Ventures at checkout is the application; selection follows published technical criteria; a not-viable verdict still allows the free second idea.
